    1. Information on how to enter this Promotion, mechanics of entry and Prize/s form part of these Conditions of Entry. Entry into this Promotion is deemed acceptance of these Conditions of Entry by each Entrant.
    2. Entry is open to Australian residents aged 18 years and over, who register their details including first name, last name, email address, mobile number, state/region and postcode to become a Cruisepilot Cruisemail member via the competition landing page: https://www.cruisepilot.com.au/competition between 09:00 am AEST on 13 August 2024 and 11:59 pm AEST on 30 September 2024 (Entrants). The Promoter is Our Vacation Centre (ABN 54 105 542 176) of registered address 58 Kingston Drive, Helensvale, Queensland 4212 (Promoter).
    3. The directors, officers, management and employees (and their immediate families) of the Promoter, Velocity Frequent Flyer Pty Ltd, their affiliated companies, or their related bodies corporate and agencies associated with this Promotion are not eligible to enter this Promotion.
    4. The Promotion commences at 09:00 am AEST on 13 August 2024 and ends at 11:59 pm AEST on 30 September 2024 (Promotion Period).
  2. Entry
    1. For automatic entry into the Promotion, Entrants must: a. Register their details including first name, last name, email address, mobile number, state/region and postcode to become a Cruisepilot Cruisemail member via the competition landing page: https://www.cruisepilot.com.au/competition during the Promotion Period.
    2. Number of entries per Entrant for the duration of the Promotion Period is limited to one (1) entry.
    3. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Illegible, incomprehensible and incomplete entries will be deemed invalid. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise including those entries not received by the Promoter.
    4. If you enter the Promotion but no longer wish to participate, please email: enquiries@ourvacationcentre.com and provide your full name and you will be removed from the Promotion.
  3. Drawing Winners
    1. The draw will be conducted at 12.00pm AEST on Wednesday October 2 2024, at 58 Kingston Drive, Helensvale, Queensland 4212.
    2. The name and state of the winner (Winner) will be announced on the Cruisepilot website https://www.cruisepilot.com.au/ and will appear online for thirty (30) days after the draw has occurred . The Winner will be notified in writing within two (2) business days of the draw date, by email where further contact information and details will be requested including, but not limited to, full name, phone, email, and residential address.
    3. If a Prize is not claimed within fourteen (14) days of the draw, a redraw will occur. A draw for any unclaimed Prizes may take place on Tuesday October 16, 2024, at the same time and place as the original draw, subject to any directions from a regulatory authority.
    4. A new Winner will be notified in writing within two (2) business days of the re-draw. The name and state of the new Winner will be published on Cruisepilot website https://www.cruisepilot.com.au/ within fourteen (14) days after the re-draw date and will appear online for thirty (30) days after the re-draw has occurred. Once a new Winner is selected the original Winner will have no claim to the Prize. If the new Winner does not claim the Prize by 09:00am AEST on Wednesday 30 October, 2024 the Prize will be forfeited by the replacement Winner.
    5. Entries not fully complying with these Competition Terms and Conditions may be deemed invalid at the Promoter's discretion. If a winning entry is deemed not to comply with these Competition Terms and Conditions, the entry will be discarded and the relevant Prize will be re-awarded in accordance with the relevant clause of these Competition Terms and Conditions as if the discarded entry had not been received.
    6. All decisions of the Promoter are final and no discussions or correspondence will be entered into.
    7. This is a game of chance and skill plays no part in determining the Winner.
  4. Prize
    1. There is one (1) prize to be won. The first valid entry drawn will win:
      1. 7-Night Royal Caribbean cruise to the South Pacific departing from Brisbane on 28 February 2025 in the Standard Balcony Cabin for two (2) people valued $2,697.52. AUD (including GST) (as of 17 July 2024). The Prize is awarded “as is” with no warranty or guarantee, either express or implied by the Promoter. A Winner may not substitute, assign, exchange, transfer or redeem the Prize for cash. Award certificates have no cash, credit or refund value, and if sold, bartered or altered would automatically be void (Cruise).
      2. 2 x return domestic Economy Choice class flights with Virgin Australia from the nearest city serviced by Virgin Australia to the winner's place of residence to Brisbane valued up to $1,660 AUD (including GST).

    2. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
    3. During the entire duration of the Prize, a nominated parent/guardian must accompany any person under 18 years of age.
    4. If the Winner is not a Velocity Frequent Flyer member, they must join the Velocity Frequent Flyer program before redeeming the Prize. If the Winner fails to become a Velocity member before redeeming the prize, the Prize will be forfeited.
    5. For the Cruise Prize component, all passengers on the Cruise must comply with all Government Regulations and Requirements to travel including completing a health declaration form at least 24 hours prior to the cruise departure date.
    6. For the Cruise Prize component, it is the responsibility of the client to ensure booking details are correct and all passenger names are correct and match passports. Full name and date of birth for the Prize Winner and their companion is due to the Promoter ten (10) days after the Prize is claimed. Name changes and booking changes incur penalties and will be required to be paid by the Winner if incorrect information has been supplied to the Promoter.
    7. For the Cruise Prize component, reservations are made in accordance with current schedules. Any change in scheduling or delays and the resulting impact on arrangements are not the responsibility of the Promoter.
    8. For the Cruise Prize component, the value of the Cruise is valid as at 2 July 2024.
    9. For the Cruise Prize component, terms and conditions apply to all bookings. It is the responsibility of the client to request and familiarise themselves with the terms & conditions for their particular travel.
    10. For the Cruise Prize component, Cruises are subject to availability.
    11. For the Cruise Prize component, cancellation and amendment fees apply including credit card surcharges once the booking has been confirmed and are the responsibility of the prize winner.
    12. For the Cruise Prize component, it is the responsibility of the client to ensure they are aware of the latest travel advice issued by the Australian Government and the latest health information for the destinations to which they are travelling. Information can be found at The Department of Foreign Affairs and Trade at www.dfat.gov.au and Travel Doctor www.traveldoctor.com.au.
    13. Flights are subject to Virgin Australia's Conditions of Carriage and other relevant policies which are located on the Virgin Australia website at www.virginaustralia.com.

    15. Virgin Australia flights are subject to booking and flight availability.
    16. To redeem the Virgin Australia flights components of the Prize, the Winner is to email: prize.winners@virginaustralia.com. The flight Prize component cannot be taken during blackout periods, including Easter, Anzac Day and Christmas and New Year public holidays.
    17. The Virgin Australia Flight Prize are for 2 passengers to travel together on the same booking.
    18. The awarding of all flights and flight booking related enquiries will be handled by Velocity Frequent Flyer and Virgin Australia Airlines. All other prize components are the responsibility of, and will be provided by, the promotor.
    19. It is your responsibility to ensure that you and your travel companion (if any) have the requisite visas, vaccinations, valid documentation (including but not limited to valid passports and visas) which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
    20. You are responsible for all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurrent in the event of unforeseen circumstances. Should you decline insurance offered by the Promoter, the Promoter will then require a signed insurance waiver form or be supplied with your current travel insurance policy number.
    21. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination or as part of the Prize.
    22. The Prize will be awarded to the Entrant named in the Entry.
    23. To be eligible to accept the Prize, the Winner must have fully complied with the entry process in Clause 5.
    24. The Prize, or any unused portion of the Prize, is not exchangeable and cannot be redeemed as cash. The Prize cannot be used in conjunction with any other special offer. This Prize is non-negotiable, non-transferable, non-exchangeable for cash in part or in full, and may not be sold to any third party, unless otherwise specified.
    25. The Promoter, Velocity Frequent Flyer and their agents and associate companies are not responsible for and exclude all liability (including negligence), for any variation in the Prize value to that stated in these Terms and Conditions.
  5. Privacy
    1. Should an Entrant's contact details change during the Promotion Period, it is the Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
    2. By accepting the Prize, Winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the Prize, including but not limited to, being interviewed and photographed. Winners will not be entitled to any fee for participating in these activities.
    3. The Promoter will be disclosing personal information to Virgin Australia Airlines Pty Ltd (Virgin Australia), Velocity Frequent Flyer Pty Ltd (Velocity) and their related companies for the purpose of providing the Prize to the Winner. If Virgin Australia/Velocity cannot collect the Winner's personal information, it will not be able to provide the Winner with a Prize. Virgin Australia/Velocity may also disclose your personal information to and/or collect your personal information from its related companies (including Velocity Rewards Pty Ltd) and third parties who provide (or help Velocity provide) products and services. Virgin Australia/Velocity may disclose your personal information to persons or organisations located in overseas countries, as described in the Virgin Australia/Velocity Privacy Policy (www.virginaustralia.com/privacy). The Velocity Privacy Policy also states how you can seek to access or correct your personal information and how to make a privacy complaint. You can contact the Virgin Australia Group Privacy Officer at privacy@virginaustralia.com. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this Promotion but no further use of this information will be made without prior consent. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Promotion, the Entrant is taken to consent to https://www.cruisepilot.com.au/privacy which contains information, among other things, about how the Entrant may access personal information that is held by the Promotere about them and seek correction of such information. For any compliants the Entrant is to email resolutions@ourvacationcentre.com.
    4. You consent to the Promoter using your personal information for future promotional and marketing purposes regarding the Promoter's products and services, including contacting the entrant via SMS, telephone or email messages (and you consent to receiving such messages from the Promoter). Information on how to opt-out from these messages is set out in the Promoter’s Privacy Policy.
    5. Entrant's personal information may be disclosed to State and Territory lottery departments and Winners' names published as required under the relevant lottery legislation.
  6. Intellectual Property
    1. The Promoter may want a Winner to participate in promotional activity after the Promotion has ended. In consideration for the Promoter awarding the Prize to a Winner, the Winner permits the Winner’s image and/or voice, as recorded, photographed or filmed during the Winner's participation in the Prize to appear in any media whatsoever throughout the world for an unlimited period and the Winner will not be entitled to any fee for such use.
    2. The Promoter reserves the right to request that a Winner provides proof of identity, proof of age, proof of residency and/or proof of entry validity in order to claim a Prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the Prize in whole and no substitute will be offered.
  7. Tax
    1. The Promoter will not be liable for any tax liability, including without limitation income tax, fringe benefits tax, or any liability or loss of opportunity due to reportable fringe benefits, incurred by a Winner, an Entrant or their employer in regards to any connection with participating in the Promotion or the receipt or use of any Prize.
    2. The Winner will be required to pay any taxes and other airport related charges (including any applicable GST on those taxes and charges) which may be due on receipt or use of the Prize.
    3. Entrants should seek independent financial advice to ensure they understand possible tax implications in relation to any tax liability and/or reportable fringe benefits before acceptance or use of a Prize.
    4. The Promoter does not accept responsibility for and makes no representations about any tax liability as a result of participating in the Promotion or from receiving or using any of the Prizes.
  8. Legal
    1. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter. The Promoter reserves the right to disqualify a Winner if the Promoter becomes aware that the Winner and/or the Winner's entry is of a type described in this clause. Any Entrant disqualified under this clause is prohibited from any further participation in the Promotion.
    2. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Promotion on the dates and in the manner described in these Conditions of Entry, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
    3. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to any written direction given under State Regulation
    4. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Promotion and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) in Australia, or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). The Promoter and its associated agencies and companies (and their respective officers, employees and agents) exclude all liability (including negligence) except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, for any direct, indirect or consequential injury, loss and/or damage arising in any way in connection with this Promotion or any Prize/s. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect or inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, Prize claims or Prizes; and (iv) acceptance and/or use of any Prize (including but not limited to any component of a Winner's trip).
    5. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this Promotion. Any Entrant disqualified under this clause is prohibited from any further participation in the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
    6. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, internet failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
    7. The Promoter is not liable for any tax implications arising from Prize winnings. Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize.
    8. In the event of a dispute, Entrants must contact the Promoter and attempt to resolve the dispute in good faith. If the matter can't be resolved, either party may refer the matter to a mediator. The costs of the mediation will be shared equally between the parties.
    9. Except for any liability that cannot be excluded by law (including the Non-Excludable Guarantees), the Promoter (including its respective officers, employees and agents) will not be liable to an Entrant for, and the Entrant waives and releases the Promoter in respect of all liability (including but not limited to all expenses, costs, damages, claims, losses) arising in any way out of or in connection with:
      1. any act or omission of an Entrant;
      2. any breach of these Terms & Conditions by the Entrant;
      3. any personal injury or death or property loss or damage;
      4. claiming the Prize;
      5. use of the Prize in any way;
      6. any theft of any Prize or unauthorised access or third party interference in the Promotion;
      7. any entry or Prize claim that is late, lost, altered, damaged, delayed, corrupted or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
      8. any tax liability incurred by a winning Entrant; or
      9. except to the extent such liability was caused or contributed to by the Promoter's negligent act or negligent omission.45.
    10. Currency: Unless the contrary intention appears, a reference in these terms or in any advertisement relating to the Promotion, to Australian dollars, dollars, AUD$ or $ is a reference to the lawful currency of Australia.
    11. Amendments: These Terms and Conditions may be amended or replaced from time to time if required by any regulatory authority.
    12. Jurisdiction: These Terms and Conditions are governed by the laws of Queensland. Entrants submit to the jurisdiction of the courts of Queensland.
